Healthy Ostriches in BC Have Been Killed After Supreme Court of Canada Refused to Hear Appeal

Universal Ostrich Farms in Edgewood, British Columbia has lost their Supreme Court of Canada appeal to stop the cull of their flock of somewhere between 300-400 ostriches.
As noted in the November 6th, 2025 Supreme Court of Canada press release, “Judgement on Leave Application,” the Universal Ostrich Farms Inc. v. Canadian Food Inspection Agency case has been “dismissed with costs.”
In essence, Canada’s Supreme Court has refused to hear the legal appeal of the Canadian Food Inspection Agency’s (CFIA) internal order to kill (or “cull”) a heard of just under 400 healthy ostriches who survived a “bird flu” outbreak which killed 69 other ostriches from the same flock almost a year ago.
Lower courts have defended the CFIA’s internal processes and defended the cull order from a procedural perspective while refusing to examine the science and the political reasons underlying the processes the CFIA uses.
The CFIA, currently on site at the Ostrich Farm, has begun moving the ostriches into a “kill pen,” essentially an open field on the ostrich farm blocked off by walls made from bails of hay to absorb bullets and block viewers on the ground from seeing what’s going on, in anticipation of the courts decision.
November 6th, 2025 Castanet post, “CFIA moving ahead with ‘complete depopulation and disposal’ at ostrich farm after Supreme Court of Canada decision,” notes that:
The Canadian Food Inspection Agency said it is moving ahead with its cull at the Universal Ostrich Farm in light of the Supreme Court of Canada’s Thursday morning decision to dismiss the application for appeal.
In a statement, the CFIA said will carry on with “complete depopulation and disposal measures as authorized by the Health of Animals Act and guided by the stamping out policy for highly pathogenic avian influenza.”

The destruction of the flock was a waste from both a scientific and economic perspective.
There were no tests performed to determine infection, no release of the data used by the CFIA to justify the slaughter, no chance for others to make an independent determination of what needed to be done and no possibility for peer review of the situation.
The birds were killed and the carcasses were left on the ground to rot. Sometime over the next few days, the remains will likely be disposed of in a landfill or burned.
